U.S. President George W. Bush signed into law Wednesday a major bankruptcy reform bill, making the most sweeping changes to the laws of personal bankruptcy in the past two decades. Bill S.256 is predicted to reduce the chances of filing Chapter 7 bankruptcy for 30,000 to 210,000 families per year, according to the American Bankruptcy Institute.

The legislation was strongly opposed by some consumer advocates and by some Democrats in Congress, who complained about the lack of debate on exemptions they attempted to introduce and tried to derail the passage of the bill. Those who are unable to file for Chapter 7 bankruptcy will then be forced to file under Chapter 13, which requires payment of some debts by order of a judge based on the financial resources of the debtor.

Opponents said the bill will end a chance for a fresh start in the financial lives of the American people by keeping them in debt to collection agencies, as well as credit card companies and banks who have made it easy to obtain high credit limits amid mounting consumer debt.

In his remarks before signing the bill, which he supported, Bush said, “The bipartisan bill I’mabout to sign makes common-sense reforms to our bankruptcy laws. By restoringintegrity to the bankruptcy process, this law will make our financial systemstronger and better. By making the system fairer for creditors and debtors,we will ensure that more Americans can get access to affordable credit.”

The bankruptcy bill received a 302-126 approval in the house, after receiving a 74-25 vote in the Senate last month following strong, mostly partisan debate.

The US bankruptcy system was established in 1898. It allowed judges and debtors to come to terms with the costly medical bills that can follow a relative’s death, or a family illness. Such cases form nearly half of all bankruptcies filed in the USA, according to the American Bankruptcy Institute.

Now many of those people will have to work out repayment plans suitable to creditors instead of having debts erased by a judge, according to the new law, which takes effect in six months.

In the past, a judge or court representative would calculate an individual’s income and subtract necessities of life to come up with a practical repayment plan of some debt. The new law stipulates that a graph, showing the poverty level in whichever state the consumer is living will be the criteria. It assumes that if people can subsist at that poverty level, then everything over that can be used to repay creditors.

Additionally, a provision that allowed debtors to file their own Chapter 7 fresh start bankruptcy has been changed to require a lawyer, paid by the debtor, to do the filing.

The new law also erased “usury” provisions in lending laws, with some lawmakers saying that paying 30 percent interest was not too much when a debtor was behind on payments.

But Bush said that credit will “be more affordable because when bankruptcy is less common, credit can be extended to more people at better rates,” meeting demands of the credit card companies which they have been pressing for the last eight years.

“The big winners under the new law will be the special interests that literally wrote it, particularly the credit card industry,” said Travis B. Plunkett, legislative director of the Consumer Federation of America. “This is particularly ironic because reckless and abusive lending practices by credit card companies have driven many Americans to the brink of bankruptcy.”

The forces arrayed on the losing side of this bill said it will hurt low-income working people, single mothers, minorities, and elderly and will end a safety net for people who have lost jobs or face major medical bills. People who fail (refuse) to pay or refuse to go to court will punished by a fine and or arrest warrant made out in their name. About fifty thousand Americans will be punished by a fine and or warrant about three thousand Americans every year will go to jail under the new bankruptcy law. For some people this will be a third strike so they will be put in jail for life.

But Mallory Duncan, a lawyer for the National Retail Federation, said “Bankruptcy has gone from a stigma to a financial planning tool for many.”

New personal bankruptcy filings have increased from 172,423 in 1978 to 1,599,986 last year, an increase of 828% during that time; however, it edged down slightly last year.

About 2 percent to 13 percent of those who dissolve their debts in Chapter 7 bankruptcy each year in exchange for forfeiting some assets will be disqualified from doing so under the law, according to the American Bankruptcy Institute.

Bankruptcy lawyers anticipate a rush to the courthouse to beat the six-month window before the new reforms take effect.

Methicillin-resistant staphylococcus aureus (MRSA), a drug-resistant strain of bacteria, killed nearly 19,000 Americans in 2005 alone, according to a new study in the Journal of the American Medical Association. That is more people than were killed by AIDS in the United States. More than 94,000 Americans were afflicted with MRSA infections in 2005.

Although the supergerm, or superbug, is primarily found in hospitals, a growing number of cases have been contracted at public gyms and schools. In Moneta, Virginia, a high school senior died from an infection that spread to his kidney, liver, lungs and heart. In Bedford County, where Moneta is located, school officials have reported five cases of the Methicillin-resistant strain of the Staph bacteria. County officials closed the schools to clean them.

“Certainly, MRSA now has to be viewed as a very important target for prevention and control,” said Dr. David A. Talan, an infectious diseases specialist at Olive View-UCLA Medical Center.

On its blog, Google, a U.S. headquartered multinational corporation specializing in Internet-related services and products, announced it would be shutting down the Spanish version of Google News, effective from December 16 of this year. The shutdown came in direct response to amendments to the Spanish intellectual property law —Ley De Propiedad Intelectual— imposing a compulsory fee for the use of snippets of text to link to news articles, by online news aggregators that provide a search service.

The Spanish intellectual property law passed the Senate on October 15, passed Congress on October 30, and would take effect starting in January 2015. Spain made the right to payment inalienable, so that even the news organization quoted is not permitted to waive it. Google News did not run ads on its news service, so did not profit directly, and said continuing to run the service would not be sustainable.

A similar fee had been first introduced in German law in 2013, where it was described as an “ancillary copyright” — Leistungsschutzrecht. International copyright law preserves the right to make quotations without remuneration, the only such mandatory limitation to copyright. In Germany publishers willingly forfeited their right to payment from Google, given how much traffic they would lose from not being indexed on Google News.

The Electronic Frontier Foundation (EFF) had expressed concerns that “these ancillary copyright laws form part of a broader trend of derogation from the right to link.” They continued, “This can be seen when you examine the other parts of the Spanish copyright amendments that take effect in January […] — notably placing criminal liability on website operators who refuse to remove mere links to copyright-infringing material.” EFF quoted the recent introduction of the so-called “right to be forgotten” legislation allowing removal of entries from Google web search results.

Original Story

Thursday, March 2, 2006

Buffalo, New York —In an unanimous vote, the City of Buffalo‘s Planning Board voted to table the Elmwood Village hotel Proposal, postponing voting on legislation for up to 30 days.

The Board said its decision was due to the lack of public involvement, saying that there have not been enough meetings.

The Elmwood Village Hotel is a proposed project by Savarino Construction Services Corporation and was designed by Karl Frizlen of The Frizlen Group. The hotel would be placed on Elmwood and Forest Avenues in Buffalo, New York. In order for the hotel to be built, at least five buildings, that include both businesses and residents, must be demolished.

The Forever Elmwood Corp. is a Buffalo-based non-profit organization founded in 1994. Justin Azzarella, the Executive Director for the organization voiced support for the proposal, stating: “I am here today to lend Forever Elmwood’s support the hotel project. Particularly, Forever Elmwood is encouraged by the fact that this building follows the more stringent Elmwood Village Design Guidelines. We have been speaking with Savarino Construction, and they have promised us [Forever Elmwood] that they will engage the community further, including the surrounding Block Clubs and businesses. For that reason, while Forever Elmwood is in support of this project and the type of project that it is, we are asking also that the project be tabled so that the community can be further engaged. Specifically the surrounding Block clubs which include the Granger, Claremont, Asland and The Lincoln Parkway Block Clubs.”

“Because of the excellent work that Karl does and the game plan that they have, I think its an ideal use of this particular location. I think that this particular type of development needs to be encouraged and promoted as opposed to roadblocked,” said a man who owns five properties near the proposal site.

However, Evelyn Bencinich, a resident of Granger Place and whose house would be located directly behind the hotel said, “My property value will be depreciated or non-existent because no one is going to want to live behind a multi-story hotel. We are facing up to a year of noisy and dangerous demolition and construction. Children, pets and even drunk rebellers could wander on site and get hurt. Traffic tie-ups caused by large machinery and garbage bins is inevitable. Where will pedestrians walk? We could experience increased unsanitary flooding in our yards and basements due to the digging and cementing for the underground parking garage. Rats will be displaced into the immediate neighborhoods and be in great abundance. Once we get past the year of nightmare construction, what if you build it and they don’t come? We could ultimately have a seven million dollar rooming house on our corner.”

Patty Morris, co-owner of Don Apparel with Nancy Pollina at 1119 Elmwood also asked that the project be tabled saying, “this has only been public knowledge for less than two weeks and the public never saw the redesign. How can you vote on anything that no one has seen yet? The Board cut off Morris saying, “so specifically you don’t have any problem with it [the design] you just…” Morris then said, “Oh I am totally against this project, but thats besides the point isn’t it.”

The planning board is also concerned that the current design may still be too big.

At one point Board member Susan Curran Hoyt said, “we know you’ve cut down your number of rooms on this project, but we still see it doesn’t seem to fit the description of a ‘botique’ hotel,” and asked Eva Hassett, Vice President of Savarino Construction, “we wonder if you could reduce the rooms further.”

“One thing I didn’t talk about was the price levels of these rooms and that will be important to know. The room rate will be somewhere between US$120 and $160 a night, which is about the same price of the Hampton Inn down town and the smaller you make the hotel, the more expensive the rooms will get. We believe that we’ve made a good compromise in terms of the size of the hotel and perhaps botique means different things to different people,” said Hassett.

The board was also concerned that there is not enough parking asking, “are there alternative plans for valet parking off-site, in the event that you have a full hotel or a large event going on?”

“We are exploring several possibilities with respect to additional parking for valet and parking near-by,” replied Hassett. “We are also exploring the possibility of using the rear of 1105 Elmwood for additional parking, which would give us an additional ten or eleven spaces.”

The new design has a total of 55 parking spaces for 72 rooms, with 39 of them underground and the rest on ground level.

Hassett also said that a “parking study” will be done on the area.

Concerns that the second floor of the hotel will be too close to the property of 605 Forest were also brought up. The board asked how far the hotel would be from the property and Karl Frizlen replied saying it would “be approximately five feet from the property line,” but he also admitted that, “I do not know exactly how close the house next door” will be from the hotel, but did say “I think the house is about four or five feet away from the property line and we [the hotel] sit right on the property line.”

The board is concerned the setback from the property is not enough saying the space between the building and the hotel is “pretty narrow.”

The City’s Common Council also agreed to table the proposal also citing the need for more public engagement and the need for more organizations to respond including the Buffalo Preservation Board and the Office of Historic Preservation.

During that meeting, Hassett also said the proposal to try and get a variance to obtain the properties of 605 and 607 Forest were “now off the agenda.”

The Common Council is expected to meet and hold a public hearing about the project and the rezoning of the properties to be demolished (1119-1121 Elmwood) on Tuesday March 7, 2006 at 2:00 p.m. in Council Chambers at City Hall. At the moment the properties are not zoned for a hotel.

Just because a doctor is trained and qualified doesn’t translate into the clinic advertising effectively and generating leads. While training at seminars and privately does equip the medical practitioner with the certifications and hands on experience that he or she needs to confidently offer a service, all of the Botox training in the world won’t take care of the business side of the clinic’s success.

After receiving hands on training at a seminar, a clinic should consider business training, which can include:

Marketing

3-Day Business Course

Business Implementation

The advantage to training with Elite Aesthetic, Medical & Business Training, is that the course focuses on the aesthetic medical industry. This gives doctors and aestheticians the insight from successful medical practitioners, who have business savvy skills, specific to the industry. Business courses combined with new certifications through seminars are a fantastic way to fast track the success of a new clinic, or to assist a medical spa that could use a boost, in the face of a new competitor.

Marketing Courses Generate Qualified Leads

Marketing is not only how to effectively advertise but how to handle the leads when they do come in. This one day course covers all angles of marketing strategy including how to attract new customers to the clinic through effective advertising, and how to write ads. The course teaches medical practitioners how to create a lead follow-up system, to make the most out of every inquiry.

3-Day Business Course

This is a comprehensive course that will explore business and marketing in-depth including:

Marketing Strategies

Business Procedures

Team Motivation

Customer Care

How to Boost the Income of a Medical Spa Clinic

This course is recommended for any clinic owner who wants to re-energize the team, increase profits and learn twelve different ways to generate leads. Every medical practitioner should be just as business-minded as they are technical and treatment focused. The seminars for Botox training and other courses will equip them with the ability to offer the service. However, every practitioner needs to know how to get that service out to the world, and make money off of their certifications and abilities. The advantage to training with Elite Aesthetic, Medical & Business Training, is that the course focuses on the aesthetic medical industry. This gives doctors and aestheticians the insight from successful medical practitioners, who have business savvy skills, specific to the industry. Business courses combined with new certifications through seminars are a fantastic way to fast track the success of a new clinic, or to assist a medical spa that could use a boost.

Business Implementation

A business implementation service will ensure that the certifications that are earned through seminars will be integrated into the doctor’s clinic. This can include evaluating the current practice, such as: marketing strategies, ROI, daily procedures and team member productivity. The service will systemize the practice, re-energize the team and provide a comprehensive implementation, to help medical practitioners put their credentials to use.

Most doctors and aestheticians do not find the success that they were hoping for because they do not have the time or training for the business implementation that is required to excel. This, in addition to marketing and business courses helps practitioners to take their new seminar certifications to a whole new level, and start generating the income that they deserve.

Taking care of your health is the most important thing that you can do for yourself to ensure a long and happy life. There are many different things that you should do in order to make sure you stay healthy, especially in today’s world where you face regular exposures to toxins in the foods you eat, the products you use, and the air you breathe. One of the best ways to stay healthy is to pay attention to healing products that work naturally and that make use of your bodys own healing mechanisms. Natural health healing products are a great alternative to traditional medicine, which can sometimes cause as many problems as it cures.

Products to Pay Attention To

There are many different healing products available to those who want to make sure that they are living the healthiest life possible. A few examples or products that you should be aware of include:

[youtube]http://www.youtube.com/watch?v=QiAonyJIV_A[/youtube]

Detox foot baths. These use energy and negative ions and the process of osmosis to allow your body to purge itself of free radicals and toxins. Free radicals have been linked to a variety of illnesses including cancer, and both toxins and a build-up of free radicals can simply cause you to feel unhealthy on a daily basis. A detox foot bath draws these unhealthy agents out of you and restores your cells to their natural frequency.

Infrared products: Far-infrared devices have many benefits. The warmth of a sauna and other infrared devices encourages perspiration, which helps improve your health. However, you can also enjoy bio-genetic waves of far infrared that are able to penetrate and deliver warmth throughout your whole body. Toxins can leave your body as a result of perspiration and the warm, healing infrared energy may help relieve muscle pain and a variety of other medical ailments.

DPL light penetrating therapy. DPL light penetrating therapy is able to naturally stimulate the growth of collagen. This can help to make your skin look younger and can help the fine lines and wrinkles that show your age to vanish. Using DPL therapy is a far more natural, less painful and healthier way to deal with wrinkles and signs of aging than either botox or plastic surgery. Results are seen quickly and there is little or no discomfort from the use of DPL therapy.

Frequency therapy. Individuals with a variety of different medical conditions including migraines, Lyme disease, arthritis and parasitic infectors are able to use frequency therapy (or Rife machines) to expose the body, its cells and pathogens to certain energy frequencies. Every cell has its own frequency and a frequency machine can use modified forms of the frequencies of disease-causing organisms to cause those organisms to be destroyed. This can help to restore the natural healthy frequency your body is supposed to have.

These are just a few examples of some of the many great products that exist that provide you with a safer, healthier and more natural alternative to traditional techniques offered by medical doctors. Trying a natural technique first before invasive and potentially dangerous therapy is always a wise choice.

Journalist, counselor, painter, and US 2012 Presidential candidate Joe Schriner of Cleveland, Ohio took some time to discuss his campaign with Wikinews in an interview.

Schriner previously ran for president in 2000, 2004, and 2008, but failed to gain much traction in the races. He announced his candidacy for the 2012 race immediately following the 2008 election. Schriner refers to himself as the “Average Joe” candidate, and advocates a pro-life and pro-environmentalist platform. He has been the subject of numerous newspaper articles, and has published public policy papers exploring solutions to American issues.

Wikinews reporter William Saturn? talks with Schriner and discusses his campaign.
